WEBSITE PRIVACY POLICY EFFECTIVE DATE: JULY 29, 2013

 1. INTRODUCTION. Double Black Software,(“us,” “we,” or “Company”) is committed to respecting the privacy rights of its customers, visitors, and other users of this website (“SubAssistant.com” or “the Site”). We created this Website Privacy Policy (“Privacy Policy”) to give you confidence as you visit and use the Site, and to demonstrate our commitment to fair information practices and the protection of privacy. This Privacy Policy is only applicable to the Site, and not to any other websites that you may be able to access from the Site, each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy.

2. INFORMATION COLLECTION PRACTICES

2.1. TYPES OF INFORMATION COLLECTED

(a) TRAFFIC DATA COLLECTED. We presently use Google Analytics to track various information about visitors to the Site.  For information regarding the types of information analyzed by Google Analytics, please visit http://www.google.com/analytics/.

In addition, we may choose to track and collect the following categories of Traffic Data when you visit our Site: (1) IP addresses; (2) domain servers; (3) types of computers accessing the Site; and (4) types of web browsers used to access the Site (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving your experience on the Site.

(b) PERSONAL INFORMATION COLLECTED. In order for you to access certain services and to fully utilize the service that we offer via the Site, we require you to provide us with certain information that personally identifies you (“Personal Information”), as well as information that will allow the SubAssistant.com software to access the Customer’s accounts on other websites.  Such information is voluntarily provided by the customer when each registers to use SubAssistant.com.   

Personal Information includes the following categories of information: (1) Contact Data (such as your name, mailing address, and e-mail address);  (2) Demographic and Location Data (such as your zip code, age, and income) and (3) Account data related to third-party websites that are accessed by the SubAssistant.com software.

If you communicate with us by e-mail, post messages to any of our chat groups, bulletin boards, or forums, or otherwise complete online forms, surveys, or contest entries, any information provided in such communication may be collected as Personal Information.

2.2. USES OF INFORMATION COLLECTED

(a) COMPANY USE OF INFORMATION.

Customer information is used, first and foremost, to allow the SubAssistant.com software to function properly, including logging in and otherwise accessing the customer’s account(s) on third-party websites, including Aesop, SmartFindExpress, and SubFinder. We may also use Customer Information to send you information about our company or our products and services, or to contact you regarding your account when necessary.

We use your Demographic Data to customize and tailor your experience on the Site, displaying content that we think you might be interested in and according to your preferences.

(b) SHARING OF PERSONAL INFORMATION.

As described above, information given by the customer at sign-up is used to log-in and access the customer’s account on various third-party substitute placement sites.  Any such use of the customer’s information will automatically be discontinued within 5 days of the closing of Customer’s SubAssistant.com account. 

SubAssistant.com DOES NOT share any customer information with any other third parties beyond those identified herein.

(c) USER CHOICE REGARDING COLLECTION, USE, AND DISTRIBUTION OF PERSONAL INFORMATION. You may choose not to provide us with any Personal Information. In such an event, you will not be able to access and use those portions of the Site that require your Personal Information. If you do not wish to receive information and promotional material from us, you may opt out by sending an email to support@SubAssistant.com expressing your desire to be removed from Double Black Software and/or SubAssistant.com’s mailing list.

3. CONFIDENTIALITY AND SECURITY OF PERSONAL INFORMATION.

Except as otherwise provided in this Privacy Policy, we will keep your Personal Information private and will not share it with third parties, unless such disclosure is necessary to: (a) comply with a court order or other legal process; (b) protect our rights or property; or (c) enforce our Terms of Service. Your Personal Information is stored on secure servers that are not accessible by third parties.

3.1. USER ABILITY TO ACCESS, UPDATE, AND CORRECT PERSONAL INFORMATION. We maintain a procedure in order to help you confirm that your Personal Information remains correct and up-to-date. At any time, you may visit and edit your personal profile at https://SubAssistant.com/account-info. Through your personal profile you may: (a) review and update your Personal Information that we have already collected; (b) choose whether or not you wish us to send you information about our company, or promotional material from some of our partners; and/or (c) choose whether or not you wish for us to share your Personal Information with third parties.

3.2. LOST OR STOLEN INFORMATION. You must promptly notify us if your user name, or password is lost, stolen, or used without permission. In such an event, we will remove that credit card number, user name, or password from your account and update our records accordingly.

3.3. PUBLIC INFORMATION. The Site contains links to other websites. We are not responsible for the privacy practices or the content of such websites. We also make chat rooms, forums, message boards, and news groups available to you. Please understand that any information that is disclosed in these areas becomes public information. We have no control over its use and you should exercise caution when deciding to disclose your Personal Information.

3.4   DISCLOSURE UPON SALE OF COMPANY OR ASSETS.  Company reserves the right to disclosure user information in the event of a merger, acquisition, or sale of any portion of the business to the new buyer.

If Double Black Software is involved in a merger, acquisition, or any other sale of all or a portion of its assets, you will be notified via email of any changes in ownership or changes in the use of your information, as well as any choice you may have regarding this information.

4. UPDATES AND CHANGES TO PRIVACY POLICY.

We reserve the right, at any time and without notice, to add to, change, update, or modify this Privacy Policy, simply by posting such change, update, or modification on the Site and without any other notice to you. Any such change, update, or modification will be effective immediately upon posting on the Site.

 6.     COOKIES

In order to ensure the functionality of the Site and to enhance your experience with SubAssistant.com, the Site makes very limited use of “cookies.”  Cookies are small text files that we place in your computer’s browser to store certain information.  While some companies employ cookies that track a wide variety of user data for advertising purposes, SubAssitant.com employs only limited cookies necessary to keep a user logged in to the system.  SubAssistant.com uses only “session cookies,” which means that the information is deleted when a user ends their browsing session, and will not persist on a user’s machine.  Most browsers are configured to accept cookies, though you can configure your browser to accept all cookies or to alert you every time a cookie is offered by any website’s browser.

SubAssistant.com’s support services utilize Help Desk Software, hosted by Freshdesk.  Freshdesk is a third-party vendor, that has different policies regarding cookies.  These policies can be found by clicking “Cookie Policy” at http://subassistant.freshdesk.com/support/home.

 7.     ADDITIONAL CONSIDERATIONS FOR MOBILE USERS (SUBASSISTANT APPLICATION)

 The SubAssistant.com Mobile Application (“The App.”) does not presently collect or store precise location information for its users or any additional information not described herein.  However, in the future, we may choose to collect this information in order to enhance the features and functionality of The App.  The App may collect certain additional information automatically, including but not limited to the type of mobile device you use, the unique device ID of your mobile devise, the IP address and operating system of your mobile device, or other information about the way in which you use the application.
